The contribution, starting from the Supreme Court ruling, 13 December 2023, n. 34858, which establishes the validity of the same, reconstructs the logical process of the ruling by declining it in an analysis aimed at retracing the reasons for the prohibition referred to in the art. 458 c.c. as well as the evolutions regarding the theory of the cause of the contract in order to understand whether this donation should be traced back to a donation or inheritance.
