The paper, taking a cue from two recent rulings with which the Supreme Court clarified the correct exegesis of the temporary exemption from the bankruptcy procedure of the so-called innovative start-ups, briefly reconstructs the state of the art in the period of force of the bankruptcy law as well as that on over-indebtedness and then it verifies the correctness of the arguments, developed in a nomophilactic manner by the Court, in the light of the new Insolvency and crisis Code and of the insolvency.

Abstract
